LAZY STENCILS — TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern your access to and use of lazystencils.com (the "Site") and any purchase of products from Lazy Stencils LLC ("Lazy Stencils," "we," "us," "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

Company: Lazy Stencils LLC (a New York limited liability company)

1. Our Products

Lazy Stencils sells physical, reusable stencil products for arts, crafts, decor, and related applications.

Physical product only. Your purchase provides the physical stencil item(s) only. No intellectual property rights are transferred except as explicitly stated in these Terms.

Intended use. Stencils are intended for craft and decorative use. You are responsible for ensuring your end-use complies with applicable laws and does not violate third-party rights.

2. Use of the Site

You agree to use the Site lawfully and not to:

Copy, scrape, reproduce, distribute, or exploit Site content without written permission
Interfere with Site operations, security, or servers
Use the Site for fraud, deception, or unlawful activity
Impersonate Lazy Stencils or misrepresent your identity

We may suspend or terminate access for violations.

3. Orders, Pricing & Availability

All orders are subject to acceptance by Lazy Stencils. We may refuse or cancel orders at our discretion, including for:

Product unavailability
Pricing or listing errors
Suspected fraud or unauthorized activity

Pricing errors. If a product is listed at an incorrect price, we may cancel the order and refund amounts paid.

4. Payment

By placing an order, you authorize us (or our payment processor) to charge your payment method for the total amount, including taxes and shipping where applicable.

Payments are processed by third-party providers. We do not store full payment card information.

5. Shipping & Delivery

Fulfillment location. Orders are fulfilled and dispatched from New Jersey, USA.

Processing & transit. Processing times and transit times vary. Delivery dates are estimates and not guaranteed.

International orders. Customers are responsible for any customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. We are not responsible for customs delays or additional border charges.

Risk of loss. Risk of loss passes to you upon delivery to the carrier, to the extent permitted by law. If an item is lost in transit, contact us and we will assist with carrier claims where possible.

6. Returns, Refunds & Exchanges

If you are not satisfied, contact us within 30 days of delivery at info@lazystencils.com.

To qualify for a return:

The stencil must be unused, in original condition, and in original packaging (if applicable)
Proof of purchase is required (order number first and last name in the order)

Return shipping. Return shipping is the customer’s responsibility unless the return is due to our error or a verified defect.

Custom orders. Custom or personalized stencils are final sale and are not eligible for return or refund unless defective or incorrect due to our error. If there is an issue with a size we can resend a new stencil.

We may refuse returns that do not meet these conditions.

7. Intellectual Property & IP Complaint Policy (Fast Takedowns)

We respect the intellectual property rights of others and expect our users and customers to do the same.

7.1 Third-Party Rights

Any third-party names, marks, or references (if present) are the property of their respective owners. Unless expressly stated, Lazy Stencils is not affiliated with, sponsored by, or endorsed by any third party.

7.2 IP Complaint Submission

If you believe any product listing or content on our Site infringes your copyright, trademark, or other rights, email info@lazystencils.com with:

Your full legal name and contact information (email, phone, address)
Identification of the work/mark you claim is infringed (registration number or proof if available)
The specific URL(s) on our Site you believe are infringing
A brief explanation of the basis for your claim
A statement that you have a good-faith belief the use is not authorized by the rights owner, its agent, or the law
A statement that the information is accurate and that you are the rights owner or authorized to act on their behalf
Your physical or electronic signature

7.3 Our Response (Fast Takedowns)

Upon receipt of a complete notice, we will promptly review the claim. We may:

Temporarily remove or disable access to the listing/content during review
Request additional information
Restore the content if the claim appears unfounded or insufficient

We reserve the right to restrict or terminate relationships with any supplier, contributor, or customer associated with repeated credible complaints.

8. Chargebacks, Fraud & Abuse

We take fraud prevention seriously. We may cancel, refuse, or hold orders for review where we reasonably suspect fraud, unauthorized payment activity, resale abuse, or policy violations.

If a chargeback or payment dispute is filed, we may provide order and shipment information (including tracking and delivery confirmation) to the payment processor or financial institution to respond to the dispute.

We reserve the right to restrict future purchases and refuse service to customers who initiate chargebacks in bad faith, engage in abusive behavior, or repeatedly dispute legitimate charges.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

9. Product Use & Safety

You are responsible for safe use of stencils and any tools/materials used with them (paint, sprays, solvents, blades, heat tools, etc.). Follow manufacturer safety instructions for any chemicals or equipment.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted or error-free.

Some jurisdictions do not allow certain warranty disclaimers; in such cases, these disclaimers apply to the maximum extent permitted.

11. Limitation of Liability

To the fullest extent permitted by law, Lazy Stencils LLC and its owners, officers, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the Site, products, or any purchase.

Our total liability for any claim relating to a specific order will not exceed the amount you paid for the product(s) giving rise to the claim, to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Lazy Stencils LLC and its owners, officers, employees, and agents from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from:

Your violation of these Terms
Your misuse of the Site or products
Your violation of any third-party rights related to your use of the products

13. Privacy

Your use of the Site is also governed by our Privacy Policy: https://www.lazystencils.com/privacy-policy

You may need to update the Privacy Policy text from time to time; any updates will apply as posted on that page.

14. Changes to These Terms

We may update these Terms at any time by posting a revised version with a new Effective Date. Your continued use of the Site after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

16. Dispute Resolution & Arbitration (AAA)

Please read carefully. This section affects how disputes are resolved.

16.1 Informal Resolution First

Before filing a claim, you agree to contact us at info@lazystencils.com with a brief description of the issue and your order details, and allow at least 30 days to attempt resolution.

16.2 Binding Arbitration

If a dispute is not resolved informally, you and Lazy Stencils agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any purchase will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.

Arbitration location: New York, New York, unless the AAA rules allow otherwise.

Remote proceedings: The arbitrator may allow proceedings by phone/video where permitted by AAA rules and applicable law.

16.3 Exceptions

Either party may:

Bring an individual claim in small claims court if it qualifies, or
Seek temporary injunctive or equitable relief in a court of competent jurisdiction to prevent imminent harm, consistent with applicable law.

16.4 No Class Actions

Disputes must be brought on an individual basis only. Class actions and representative actions are not permitted, to the extent allowed by law.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
